Nevada Bill Could Intimidate Creators from Enforcing Their Rights

ImageRights has submitted a formal letter opposing Nevada Senate Bill 332, a deeply concerning proposal that could disenfranchise rightsholders—especially independent photographers and artists—from asserting their copyrights for fear of being sued under state deceptive trade practice laws.
 
If passed, S.B. 332 would allow alleged infringers to bring civil lawsuits against rightsholders based on vague and burdensome criteria defining “bad faith” copyright claims. These criteria include failing to include registration numbers, or the names and addresses of all copyright owners and assignees—details that are not required under federal law and often impractical in cases of widespread online infringement.
 
Indeed, deeming what are standard and legitimate practices in copyright enforcement as factors favoring a finding of “bad faith” would reduce meaningful access to civil remedies for all rightsholders. This, in turn, would have a chilling effect, intimidating legitimate rightsholders—especially individual creators and small businesses that lack the resources for protracted, expensive, and burdensome litigation—from enforcing their rightful claims for fear of making, or inadvertently making, a mistake in their communications.
 
Rather than curbing true bad actors, S.B. 332 would embolden infringers and place legitimate creators, who already face an uphill battle in protecting their work, at even greater disadvantage. We strongly urge Nevada lawmakers to reject this bill and preserve the integrity of copyright enforcement.
